Copyright Infringement - Not Stealing Actual Image But Taking One Similar

Here's a link to a Copyright Infringement case in the U.K. which has some interesting twists.  The image was not stolen, rather a similar but not exact photo taken and edited similarly. 

So when you guys are all standing next to me at the airport, taking the same photos as me, you're infringing on my copyright, and I will prosecute!!! ;D :P

This could get complicated so here is a proposal.  Next time we shoot at El Centro we can each take the guy standing to our right to court.  I'll be standing at the far left.
